CONCERNING
EXTENSION OF STIPULATION OF TARIFF OF IMPORT DUTY IN THE FRAMEWORK OF
NORMAL TRACK ASEAN-CHINA FREE TRADE AREA (AC-FTA)

THE MINISTER OF FINANCE OF REPUBLIC OF INDONESIA,

Considering:

• a. that, stipulation of tariff of import duty in Framework of ASEAN ・China free Trade Area (AC-FTA) Normal track of 2006 as stipulated by regulation of the minister of Finance No. 21/PMK.010./2006 already expired on December 31, 2006;
• b. that, to create a legal framework to ensure implementation of the said tariff, it is necessary to extend the term of validity of the Regulation of the minister of Finance No. 21/PMK. 0.10/2006;
• c. that, based on the considerations as intended in paragraphs a and b, it is necessary to stipulate regulation of the Minister of Finance on Extension of Stipulation of Tariff of Import duty in the Framework of ASEAN-China Free Trade (AC-FTA) Normal track;

In view of:

• 1. Law No. 10/1995 on Customs affairs (statute book of 1995 No. 75, supplement to statute book No. 3612) as amended by law No. 17/2006 (statute book of 2006 No. 93, supplement to statute book No. 4661);
• 2. Presidential Decree No. 48/2004 on Ratification of Framework Agreement on Comprehensive Economic Cooperation between the Association of South East Asian nations and The People's Republic of China (statute book of 2004 No. 50);
• 3. Presidential Decree No. 20/P/2005;
• 4. Decree of the Minister of Finance No. 101/MK.05/1997 on Customs manifest as has already been amended several times and latest by Regulation of the Minister of Finance No. 48/PMK.04/2005;
• 5. Regulation of the Minister of Finance No. 56/PMK.010/2005 on Program of Reduction/ Invalidation of Tariff of Import duty in the Framework of ASEAN-China Free Trade Area (AC-FTA) Normal Track 2006;
• 6. Regulation of the Minister of Finance No. 21/PMK.010/2006 on stipulation of Import Duty in the Framework of ASEAN-China Free Trade Area (AC-FTA) Normal Track 2006;
• 7. Regulation of the minister of Finance No. 110/PMK.010/2006 on stipulation of system of Classification of Goods and Imposition of Import Duty on Import Goods;

HAS DECIDED:

REGULATION OF THE MINISTER OF FINANCE OF EXTENTION OF STIPULATION OF TARIFF OF IMPORT DUTY IN THE FRAMEWORK OF ASEAN CHINA FREE TRADE AREA (AC-FTA) NORMAL TRACK

Article 1

Extending the term of validity of regulation of the Minister of Finance No. 21/PMK.010/2006 on Stipulation of Tariff Import Duty in the Framework of ASEAN-China Free trade Area (AC-FTA) normal track 2006 until date of stipulation of regulation of the Minister of Finance on Stipulation of Tariff of Import Duty in the Framework of AC-FTA normal track of 2007.

Article 2

(1) Classification of tariff code in regulation of the Minister of Finance No. 21/PMK.010/2006 is adjusted to classification of tariff schedules as written in Indonesian Import duty Tariff Book (BTBMI) of 2007 by using Correlation table.

(2) As for tariff which are consolidated in BTBMI of 2007, the highest tariff of import duty is set forth in regulation of the Minister of Finance No. 21/PMK.010/2006.

(3) If the tariff of import duty as intended in paragraph (2) is higher than the general import duty tariff (MFN), the one that prevails is the tariff stipulated based on general import duty tariff (MFN).

(4) In case that the stipulation of tariff in regulation of The Minister of Finance on Stipulation of Tariff of Import duty in the framework of AC-FTA of 2007 as intended in Article 1 is lower than the tariff stipulated in regulation of the Minister of Finance No. 21/PMK.010/2006 during the extended period of effectiveness, excess of payment of import duty is restituted in accordance with the laws in force.

Article 3

The Director General of Customs and Excise is instructed to implement the provisions of this regulation.

Article 4

This regulation comes into effect as of the date it is stipulated and is retroactive from January 1, 2007.

For public cognizance, this Regulation is published in the State Gazette of the Republic of Indonesia.
